Following the launch of her clothing line Material Girl last year, pop singer Madonna was

suit for using the same name as Apparel manufacturer L.A. Triumph. For AW10, Madonna introduced the Material Girl range at Macy’s with Kelly Osbourne modelling the pieces.

L.A. Triumph filed the lawsuit for using the same name as their clothing line. Madonna’s defendants say the name ‘Material Girl’ is copyright protected since the release of the ’84 song. The question is if this covers merchandise trademark as well.

L.A. Triumph sells clothing under the name Material Girls since 1997 while Madonna started in 2010 with the MG Icon, the joint venture of Madonna with her manager Guy Oseary, and the Iconix Brand Group. Now a year later, Judge S. James Otero of US District in LA has rejected the arguments of MG Icon’s request to senior right of Material Girl.
